Jai Win - Terms of Service

Use of the site

By accessing or using Jai Win at jaiwin.club ("Site"), you agree to be bound by these Terms of Service. If you do not agree with any part of these Terms, please discontinue use of the Site immediately. These Terms constitute a legally binding agreement between you and Jai Win and govern all interactions you have with the Site, including browsing, account registration, and any transactions carried out through supported payment methods such as PhonePe, Google Pay (GPay), and BHIM UPI.

Eligibility

You must be at least 18 years of age and legally capable of entering into a binding agreement under applicable Indian law to use this Site. By accessing the Site, you represent and warrant that you meet these requirements. Users accessing the Site from jurisdictions where the content or services are restricted or prohibited do so at their own risk and are solely responsible for compliance with local laws.

Permitted use

You may access and use the Site solely for lawful purposes and in accordance with these Terms. You agree not to: use the Site in any manner that violates applicable local, state, national, or international laws; attempt to gain unauthorised access to any part of the Site or its servers; transmit unsolicited advertising or spam; introduce any viruses, trojans, or malicious code; or scrape, harvest, or collect data by automated means without our prior written consent. Any conduct that restricts or inhibits another user's experience is strictly prohibited.

Account responsibilities

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately at [email protected] if you suspect any unauthorised use. Jai Win will not be liable for any loss arising from your failure to safeguard your credentials. We reserve the right to suspend or terminate accounts found to be in breach of these Terms without prior notice.

Intellectual property

All content, features, and functionality available on the Site are the exclusive property of Jai Win or its licensors and are protected under the Copyright Act, 1957 (India) and applicable international intellectual property laws. Unauthorised reproduction, distribution, or modification of any Site content constitutes infringement and may result in civil or criminal liability.

Ownership of content

The Jai Win name, logo, trademarks, and all related product and service names, designs, and slogans are the proprietary marks of Jai Win. All text, graphics, images, audio, data compilations, and software published on the Site are owned by or licensed to Jai Win. Nothing in these Terms transfers any intellectual property rights to you. Any goodwill generated from use of Jai Win's marks accrues solely to Jai Win.

Limited licence

Jai Win grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site and its Content for your personal, non-commercial purposes only. This licence does not include the right to reproduce, distribute, or create derivative works of any Content, use data-mining or scraping tools, or download account information for third-party benefit. Any use of Jai Win's name or trademarks beyond what is expressly permitted requires prior written consent.

Limitation of liability

To the fullest extent permitted under the Information Technology Act, 2000 and other applicable Indian law, Jai Win, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site, even if Jai Win has been advised of the possibility of such damages. This includes, without limitation, loss of profits, loss of data, loss of goodwill, or service interruption.

No warranty

The Site and all Content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Jai Win does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. You assume full responsibility for any risk associated with your use of the Site.

Aggregate liability cap

Where liability cannot be fully excluded by law, Jai Win's total aggregate liability to you for any claim arising from your use of the Site shall not exceed the amount you paid, if any, to access the Site in the three (3) months immediately preceding the event giving rise to the claim. Nothing in these Terms limits liability for death, personal injury, or fraud caused by Jai Win's gross negligence or wilful misconduct.
